Idaho Medical Marijuana Card Legislation
Idaho has had a few cases of attempting to create a system for medical marijuana in Idaho. Medical Marijuana initiatives were put onto the ballots in the years 2012, 2014, 2016, 2018, and 2020 but all failed to gather 6% minimum signatures.
In 2019, Gov. Brad Little signed an executive order to allow hemp from other states to pass through Idaho, as it is required via the Federal US Farm Bill of 2018.
In 2020 there was an attempt to legalize hemp cultivation in Idaho, as it passed the Senate but was held in committee once it reached the House and has not been voted on.
Idaho Medical Marijuana Cultivation & Possession Laws
In Idaho, possessing 3 ounces or less of marijuana is a misdemeanor which is punishable by up to 1 year of incarceration and a $1,000 fine. Those in possession of more than 3 ounces, but less than a pound, can be charged with a felony and sentenced up to 5 years in prison and a $10,000 fine. Cultivation of cannabis in Idaho is entirely illegal.
