Indiana Medical Marijuana Card Legislation
Indiana does not have medical marijuana or recreational marijuana legalization. In 2017, Gov. Eric Holcomb signed HB 1148 which allowed the use of CBD oil containing less than 0.3% THC for patients with uncontrollable seizures, who’s symptoms were unaffected by traditional medicine treatments. HB 1148 legalized hemp-derived CBD but did not create a way for patients to purchase it.
Due to the overall vagueness of HB 1148, in March 2018, Holcomb signed SB 52 to allow the use and sale of CBD for any purpose if it contained less than 0.3% THC. This law also created additional requirements for testing and labeling of CBD.
Indiana Medical Marijuana Cultivation & Possession Laws
In Indiana possession of less than 30 grams of marijuana or less than 5 grams of hash is a misdemeanor with a penalty of up to one year imprisonment and a fine up to $5,000. With possession of more than 30 grams of marijuana, or multiple offenses would be a class D felony, which calls for 6 months to 2.5 years in prison, as well as a fine up to $10,000.
