South Dakota Medical Marijuana Card Legislation
Being the first state to legalize medical and recreational marijuana in the same year, South Dakota passed the Constitutional Amendment A, the Marijuana Legalization Initiative. This law legalized recreational marijuana in South Dakota for adults 21 and older. This law also required the state legislature to pass laws providing for the sale of hemp and the establishment of a medical marijuana program by April 1, 2022. Marijuana sales will be taxed at a rate of 15%. Voters also passed Measure 26, which legalized medical marijuana as well as the sale, manufacturing, cultivation, and delivery of marijuana for people with debilitating conditions and took effect on July 21st, 2021.
South Dakota Medical Marijuana Card Cultivation & Possession
As of July 1, 2021, adults 21 and older can legally possess up to 1 ounce of marijuana with no more than 8 grams of that being in concentrate form. Adults will also be able to grow three marijuana plants and possess the harvest if there are no retails nearby. Medical marijuana patients of South Dakota will be able to possess up to 3 ounces of medical marijuana and may cultivate up to 6 plants.
